In Mombasa county, a presiding officer and his deputy were arrested for not counting votes.
An incident that occurred in Kisauni constituency, stated that the two refused to do what was required of them by the independent electoral and boundaries commission.
Police in the area, arrested the two stating that they halted the counting votes after their a certain candidate was garnering more votes than their favourite candidate.
Returning officer in Kisauni constituency, Ibrahim Wario, is the one who reported the incident stating that even after pleading to the two to continue with the counting process they refused.
Daniel Masamba,Nyali police commander confirmed that the duo will be charged accordingly. The offence they committed is punishable by the law.
Willingly refusing to count votes is an electoral offence in ACT 2016.
Masamba stated, “The suspects are already in police custody awaiting to be arraigned in court to face relevant charges.”
A police report went ahead to state what they constitution required of them and what will befall the duo.
It stated, “They will be charged with willfully rejecting or refusing to count any ballot paper which they knew or had reasonable cause to believe such a person was entitled to vote which is an offence under the election Act of 2016.”
In line with that, on Monday, Independent electoral and boundaries commission officials were arrested for secretly meeting up with a politician , an act that is contrary with the law.
According to the returning officer from the area, the arrested had plans of rigging votes for the anonymous candidate.
The returning officer states that, although, the motives of the meeting were not clearly stated, it was against the constitution for officials to be in secret contact with the balloted candidates.
The arrested IEBC officials are still in custody as they await for their fate from the authorities as per the constitution
