Attorney general nominee, Justin Muturi dodges question on DPP Noordin Hajji recent withdrawal of charges.
During his vetting, Muturi told the legislators that it will be premature to give a stand on the dropped charges since the reasons to do so are not yet known to the public.
Muturi said,”Since the reasons for actions taken by DPP were not made public, it will be premature to start ascribing particular position on those dropped charges.”
Muturi however, commented that the director of public prosecution is constitutionally mandated to commence, take over and drop criminal charges except any that are not before a court martial as stipulated in Article 157 of the Constitution.
“In fact, it says that the DPP will not withdraw except with the leave of the court,” Muturi added.
DPP Hajji’s recent move to withdraw charges has raised alot of mixed reactions.
Some leaders said he has constitutional right to do so , while others say it is a politically motivated move.
