Case against Opiyo Wandayi and other Azimio allies dropped after Raila’s demands yesterday.
Yesterday, During his Address, Azimio la umoja leader, Raila Odinga called for closing of cases of Azimio allies who were protesting during the mass action.
He stated,” In accepting the call for dialogue, We ask that all arrests and prosecutions related to our demonstration to be stopped with immediate effect.”
Speaking to the media, lawyer Danstan Omari confirmed that the Director of Public Prosecution (DPP) Noordin Haji dropped case against Opiyo Wandayi, Madzayo, and four others who were charged with destruction of property during the mass action.
Omari stated,”The application was made orally by the prosecutor to which our team responded to. Magistrate Boaz Ombewa granted the request by the DPP.”
Lawyer Omari stated that the lawmakers, will be refunded their cash bail of sh. 500, 000.
Others who will also be refunded include; Kilifi South member of parliament Richard Chonga, Malindi Member of Parliament Amina Mnyazi, George Obure and Esher Oromi.
The court withdrew the cases citing that this will create an ample environment for the aggrieved parties to settle issues with the state.
The court ruled,”We wish to withdraw the case under section 87A of the Penal Code to create an enabling environment for peace between the accused persons and the state. I urge that the matter be withdrawn.”
While accepting the ruling, Lawyer Danstan Omari expressed that there should be amendment of a law that will prohibit police from dealing with political matters.
