The courts can say what they said but they can never repeal the Finance Act- Khalwale.
Speaking on Thursday, The United Democratic Alliance senator, Boni Khalwale, outlined that the court can never revoke the Finance Act, no matter what they say.
He highlighted that the only arm of the government that has this jurisdiction is the legislation( The National Assembly).
He stated,”The only organ of the constitution that has the power to make decisions that assume the force of law is Parliament. The courts can say what they said but they can never repeal the Finance Act.”
He further outlined that taxes are being paid, based on the current Finance Act and the cost of living is already high
He stated,”There is no crisis in the country, taxes are still being collected because whatever the court said cannot be assumed to have repealed the existing act so life goes on.”
Notably, The senator pointed fingers towards the media saying that they have already painted this ugly picture of the Finance Act and that’s why everyone thinks it is bad.
He stated,”The media has already taken a position on the finance act that’s why you like to hype issues that make Kenyans anxious as if life is coming to an end.”
This comes a day after the court, led by Justice Thande Mugure, extended conservatory orders suspending the Finance Act 2023, to Monday, July 10.
