Azimio Signature collection Abluff; Defence cabinet secretary, has downplayed Azimio la umoja’s quest for signatures, calling it abluff.
He outlined that impeachment of the head of state is entirely up to the three arms of the government, which are the executive, judiciary and the legislator.
He highlighted that no one can assume the role or directly influence the decision that come from the three arms of the government since it will be against the constitution of Kenya.
Duale stated,” Article 1(3) provides that sovereign power is delegated and exercised through Parliament, Executive and the Judiciary,”
“One cannot choose or purport to state that they have decided to exercise the power directly as this would be tantamount to negating Article 1(3) of the Constitution and assuming the three arms of government do not exist,” he added.
He further stated that collection of signatures has no constitutional basis because the constitution of Kenya, clearly outlines the procedure to remove a president from State house.
Duale said,”Collection of signatures has also no constitutional bearing. The Constitution provides clearly for the procedure for removal of the President and Deputy President under Articles 145 and 150 respectively which is through an impeachment legislative process with clearly defined constitutional grounds for removal.”
