High Court stops Gov’t from deploying Kenyan officers to Haiti.
Justice Chacha Mwita issued a conservatory order barring the government from deploying 1,000 Kenyan officers to Haiti.
The court ruled,”That a conservatory order is hereby issued restraining the respondents from deploying police officers to Haiti or any other country until October 24, 2023.”
This comes after the government of Kenya got an approval from The United Nations Security Council (UNSC) on the 2nd of October.
In his ruling, Justice Chacha stated that the petitioners raised matters that were of national importance and that required urgent consideration.
He ruled,”That the petitioners will then have three days after service to file and serve a supplementary affidavit, if any, together with the written submissions to the petition, not exceeding 10 pages.”
“That once served, the respondents will have 3 days to file and serve written submissions to the petition also not exceeding 10 pages,” he added.
This comes a day after the Interior cabinet secretary, Kithure Kindiki, outlined that Deployment of security officers to Haiti will not in any compromise or undermine our commitment and responsibility to safety and security of our citizens.
He stated,”The request by United Nations Security Council for deployment of Police officers to Haiti will be subject to Parliamentary approval. Article 240 of the Constitution requires Parliament to approve deployment of security forces to any peacekeeping mission in foreign nations.”
“There will be no shortcuts or violation of the Constitution in deployment of our police officers to Haiti. Kenya has previously contributed troops to peacekeeping missions in Namibia, Sierra Leone, Liberia, Somalia and Congo,” he added.
