Judiciary Responds To Claims That Wife To Kivuti’s Shooter was on Life Support At The Time of Hearing.
According to the Judiciary, the suspect in a Ksh.2.9 million fraud case was initially granted bail but later forfeited it after missing several court appearances.
Following several absences, she appeared in court on January 5, 2023, pleaded not guilty, and was released on bond.
Court documents reveal that she continued to miss court dates, resulting in significant delays in the case.
During an appearance in court on June 13, the day of the tragedy, the prosecution determined that the medical documents she presented in court to justify skipping the appearances were fraudulent.
“An investigation revealed that the documents were false, prompting the prosecution to request her remand,” court papers reveal.
During the court session, the prosecution argued that the missed court appearances and dubious medical documents made her a flight risk.
According to court documents, the defence apologised for presenting fake documents, claiming that the misinformation was provided by the accused and her husband.
Magistrate Kivuti ordered that the accused be remanded in Langata Women’s Prison pending a pre-bail report.
The court also ordered an ambulance to accompany her to the hospital if necessary, and scheduled a case mention for June 27th, 2024, with a hearing on August 6th, 2024.
Shortly after the ruling, a senior police officer said to be married to the accused shot the judge multiple times.
She would succumb to her injuries two days later while undergoing treatment.
