Double Blow to Kindiki as Another Court Issues Orders
Double Blow to Kindiki as Another Court barrs him from assuming the office of the deputy president after he was approved by the National Assembly.
This comes after a suit waas filed by David Mathenge and Peter Kamotho who challenged the Senate’s decision to impeach Rigathi Gachagua from office.
This ruling follows a High Court sitting in Nairobi where conservatory orders were issued stopping the appointment of Kithure Kindiki as the Deputy president.
In the initial orders, the court observed that the petition filed by Gachagua’s legal team raised monumental constitutional issues affecting not only the functioning constitution but also its fundamental tenets of the rule of law.
The court further underscored that the petition raised substantial questions of law and public interest and therefore fit to be heard by a bench of judges appointed by Chief Justice Martha Koome.
Kithure Kindiki’s nomination was on Friday approved by the National Assembly minutes after the Head of State handpicked him for the second in command position.
