Busia Senator, Omtatah issues a warning to EPRA after defying court orders on Finance Act 2023. This comes after the high court of Kenya, suspended the Finance Act 2023 hence blocking it from taking effect.
However, The Energy and Petroleum regulatory Authority, hiked the fuel prices with Petrol retailing at 13.49, Diesel at Sh12.39 and Kerosene at Sh11.96 in Nairobi.
The senator highlighted that he will go after any individual, body or institution that will go against the court order and hike commodities.
He stated,”The second order, the court says thou shall not do anything about that bill to impose it on Kenyans.That will be an order EPRA needs to take seriously because if they don’t we shall be after them.”
Okiya stated that he hope the energy regulatory authority will comply to the court order, before things take another turn.
He stated,”They have ample knowledge that the court has issued orders, it’s in the media and all over. It will not have any defence against that order. So I hope that EPRA will obey that order.”
While in court, Okiyah had argued that several laws in the Finance Act 2023, have nothing to do with raising revenue and laws that hinder the work of the Senate to protect the interests of both governments
The second petition to stop the implementation of the Finance Act was filed by Peter Agoro, who argued that the Finance Bill 2023 was founded on illegality and thereby infringes and violates the Constitution.
