Court issues Warrant of Arrest Against Kisii County Secretary.
Kisii County Secretary, James Ntabo, is currently a wanted man.This comes after he made it impossible, for three plaintiffs to live peacefully.
The three were inconvenienced by an illegal construction of a murram road on their land in Bassi Bointangare, Bobasi Sub-County seven years ago by the secretary.
In a ruling that was made by Kisii environmental court Judge Hillary Nyamu, It was decided that litigants – Elias Nyamari, Juvinalis Nyamweno and Joyce Buyaki- be paid a total of Sh373 500 for the trespass and subsequent destruction of their crops and trees during the tragedy.
According to the court paper, The plaintiffs had accused the County Secretary, Mr. James of sending ‘his officers and tractors to make or create a new road to pass through their farms’.
They outlined that the James did not stick to the laid down regulations of compulsory compensation by taking away private land as required by law.
Notably, Through their Lawyer Samson Sagwe, They saw it fit that the court grants a permanent injunction against the County by itself, its agents or servants and, or otherwise dealing with the property being land parcel numbers Bassi Boitangare 888, 2182, 2009 respectfully.
Kisii Central Police Station OCS has since been instructed to effect the arrest by Tuesday next week.
