Over ksh100,000 Fine for anyone selling herbal claimed to be Therapeutic- MoH
According to the ministry of health, Over ksh.100,000 Fine or imprisonment for a term not exceeding one year or both will be imposed to herbalists selling drugs without sticking to the laid out regulations.
According to a bill presented to the National Assembly, Herbal medicine is plant-derived material or preparations with a non- proven efficacy.
The bill stated,”A person shall not sell any therapeutic cosmetic that contains any substance that may cause injury to the health of the user when used.”
The bill also outlined that the herbs contain either raw or processed ingredients from one or more plants or materials of inorganic or animal origin.
The herbalist will be guilty if the drug was used according to directions on the label or for such purposes and by such methods of use as are customary.
They stated,”The Authority, in the public interest may prohibit any ingredient contained in therapeutic cosmetics by notice in the Gazette,”
If the bill is passed into a law, It will be illegal to sell herbal medicine that has been prepared, preserved, packed or stored under non- standard conditions.
The drugs Authority will also provide regulations for medical devices and other health technologies. Additionally, It will effect to the principles and objects of the devolved government in drug safety regulation.
