MP John Waluke makes his final submissions at Court of Appeal as he stares at a 67 yr Jail term.
Sirisia MP John Waluke makes his final submissions at the Court of appeal where he stood his ground saying he is innocent.
Apart from a 67 year jail term, legislator Waluke is also likely to lose his Parliamentary seat or pay a fine of Ksh.1.2 billion.
He virtually appeared before a three-judge bench of the Court of Appeal, where through his lawyers, Otiende Amolo and Elisha Ongoya, he told the Appellate Court judges that the Ksh.313 million that was the basis of his conviction was lawfully paid out to him and Wakhungu.
He cited that the money was paid lawfully following an arbitral award which was confirmed by the High Court against the National Cereals and Produce Board (NCPB) for breach of contract.
The lawyers further pleaded with the court to determine whether payment of monies made pursuant to court proceedings arising from an arbitral award and payment made pursuant to a garnishee order can sustain a criminal charge and conviction.
“Our client remains innocent, and we pray that this honourable court will review this matter and set the record straight,” The lawyers stated.
Waluke highlighted that he was wrongfully convicted and his case misunderstood, maintaining that the harsh penalty of 67 years in jail was politically influenced.
Legislator Waluke is currently out of prison on a Ksh.10 Million cash bail issued in November 2022.
