Jowie has been sentenced to Death.

Jowie has been sentenced to Death: The first accused [Joseph Irungu , alias Jowie,] was found guilty in the judgement delivered on February 9.

Convict Jowie Irungu pleaded to be spared death sentence; he asked Judge Grace Nzioka to pass a custodial sentence, saying he is a first-time offender.

He added that he is aware that nothing he says will relieve the pain of the deceased family. He says he expresses his sadness in the tragic loss of life in extreme circumstances bordering an act of absolute madness that is beyond understanding.

When a judgement is being delivered, the court asks itself what the appropriate reasonable sentence is and whether justice been served.

According to Justice Nzioka, the  court considered the aggravating and mitigating factors in this case:
1. Proportionality- The sentence issued must be proportional to the crime.

2. Equality, consistency, transparency and accountability.

3.Inclusiveness- Needs to respect the fundamental rights of the parties involved

4.All the treaties and conventions of the laws of this country

The Prosecution filed that the deceased’s lifeless body was found lying in bathtub with her throat slit. A serious weapon was used and after the offense there was attempts to conceal the evidence.

Monica Kimani’s family invited the court to consider that the accused was the main offender acting alone. They defined the crime as cold murder, submitted that the family has been affected economically and her business was affected.

Judge Nzioka stated,” The victim’s family, in their submission, drew the court’s attention to the sentence provided for the offense of murder, which states that a person convicted of murder shall suffer death.

“They invited the court to take note of the fact that the accused person did not play a peripheral role in the commission of the offense but was the main perpetrator. They described the murder as cold-blooded, ghastly, and barbaric,” she added.
