High Court Directs That DCI Will Not Arrest Jimmy Wanjigi: Judge Bahati mwamuye has issued temporary orders barring police from arresting and detaining businessman Jimi Wanjigi pending hearing and determination of a case filed.
The Statement Read;
I have read the Certificate of Urgency dated 08/08/2024 and the accompanying Affidavit in Support of the Certificate of Urgency also dated 08/08/2024, the Notice of Motion Application dated 08/08/2024 and the Chamber Summons of even date, and the Supporting Affidavit dated 08/08/2024 deponed by Jimi Wanjigi; all of which were filed alongside a Petition dated 08/08/2024. Consequently, I HEREBY ORDER AND DIRECT THAT:
1. The Application dated 08/08/2024 be and is hereby certified urgent and shall be heard on a priority basis.
2. Pending the inter-partes hearing and determination of the Application dated 08/08/2024, a conservatory order be and is hereby issued restraining the Respondents jointly and severally, their servants, agents, or third parties acting under the direction or authority of the Respondents from detaining, arresting, or restraining the liberty and freedom of movement of the Petitioner/Applicant, Jimi Wanjigi.
3. In the event that the Respondents jointly or severally, their servants, agents, or third parties acting under the direction or authority of the Respondents have as at the date and time of the issuance of this Court Order detained, arrested, or restrained the liberty and free movement of the Petitioner/Applicant; a further conservatory order be and is hereby issued directing the Respondents jointly and severally, their servants, agents, or third parties acting under the direction or authority of the Respondents to immediately free the Petitioner/Applicant and to take all necessary measures to ensure the same; pending the inter-partes hearing and determination of the Application dated 08/08/2024.
4. The Petitioner/Applicant shall serve the Petition and Application on the Respondents
