In a three judge bench, Justices Aggrey Muchelule, Gatembu Kairu, and Weldon Korir rejected the move to suspend the six months sentencing that was appealed by Masengeli through his legal team.
The Legal team Led by Cecil Miller and State Counsel Emmanuel Bitta the had appeared before the court of appeal to temporarily stop the sentence pending the appeal.
However, the court set the hearing for next week by a bench appointed by the president of the Court of Appeal
The trio also granted the Law Society of Kenya (LSK) two days to file their responses in the matter pushing for Masengeli to be held personally responsible for his refusal to obey the seven court orders.
According to Masengeli’s appeal, Justice Lawrence Mugambi was biased in his ruling and faulted the judge for disregarding his reply regarding the affidavit to the case.
