Blow To Former Governor Sonko As High Court Overturns His Acquittal in Ksh357 Million Graft Case
Former Nairobi Governor Mike Sonko suffers setback after High Court overturns his acquittal in a Ksh 20 million graft case.
The ruling delivered by Justice Nixon Sifuna on Wednesday directs that the case be retried by a different Magistrate, after finding that the lower court, led by Magistrate Douglas Ogoti, erred in acquitting Sonko and his co-accused, businessman Antony Ombok.
Magistrate Ogoti threw out the case in December 2022, citing a lack of evidence but Justice Sifuna stated that the acquittal was made in error and should not have been so general.
The Office of the Director of Public Prosecutions (DPP) had appealed, arguing that the trial Magistrate had relied on an outdated charge sheet and failed to address the specific evidence for each count in the case.
The DPP now seeks for the case to proceed under the amended charge sheet.
