A man from Migori county has been publicly arrested by Directorate of criminal investigations officers after a local pastor aired a grief complaint against him prompting the law enforcers from the area to detain him.
According to the popular media personnel and blogger Oimbo Onchieku, the man above was allegedly accused of sharing naked photos of a pastor in a church based WhatsApp group
The man claimed that the preacher was secretly sending his nude photos to his wife which is absurd , since the preacher is a man of cloth and its is disrespectful to their marriage.
According to the man, the nude photos disturbed him hence prompting him to take the action of posting the photos to the church WhatsApp group.
The arrested man went ahead to state the pastor had made advances to the wife earlier by appointing her as the church choir head . He termed the advances as luring inorder to get his wife.
According to the European Court of Human Right which is worth quoting:-
“A person’s image constitutes one of the chief attributes of his or her personality, as it reveals the person’s unique characteristics and distinguishes the person from his or her peers. The right to the protection of one’s image is thus one of the essential components of personal development. It mainly presupposes the individual’s right to control the use of that image, including the right to refuse publication thereof.”
The right to privacy is guaranteed under Article 31 of the Constitution of Kenya.
Privacy has been stated as “The right of the individual to be protected against intrusion into his personal life or affairs, or those of his family, by direct physical means or by publication of information
So In line with that, posting pictures someone without their consent or agreement is lawfully considered a crime and that is taken as a breach of privacy.
