After the announcement of the presidential election, there is a certain transition that takes place according to the constitution.
According article 134 of the constitution of Kenya, a certain criteria is followed for a presidential transition to be acceptable by the constitution.
1. Presidential Elections
This is an exercise that was performed by the citizens of Kenya on 9th August 2022. It is mandated to be not only a free and fair exercise but also a credible process.
2.IEBC Results announcement
This takes places within a period of seven days from the election days. The independent electoral and boundaries commission chair, is expected to announce the result through the form 34D. This is after tallying of the results from the forms 34A and 34B then afterwards verification in the form 34C.
A presidential candidate must surpass the 50%+1 vote in order to be declared the president elect.
3.IF no petition;
The swearing in exercise must take place. This will take place on the 30th of August 2022. This will be followed by handing over exercise presided over by the chief justice, Martha Koome.
The swearing in consists of the words that the president elect will adhere including acting as per the constitution.
The outgoing president will hand over the instruments of leadership such as the sword of power that was given to him when he was chosen the president 5 years ago.
This will follow the retirement of the current president as the president elect takea over office.
4. IF there’s a petition
The case is taken to the supreme court of Kenya. A case that will be heard by 16 judges of the supreme court headed by chief justice, Martha Koome.
If the supreme court declares there was no clear winner in round one, a fresh election will be conducted within 30days.
However, the re-run election will only be for the top two presidential candidates.
