Former Malindi member of parliament Aisha Jumwa got a reprieve after a Mombasa Court temporarily suspended a warrant of arrest against her.
The former member of parliament is charged alongside seven others with working together to commit an offence punishable in the law of law that, fraud.
It is alledged that,Aisha Jumwa together with the seven, paid a total of 19,007,539.60 to a company.
According to Aisha Jumwa’s lawyer, Jared Magolo, he stated that his client is currently admitted at a health care facility and not in a condition to be arrested.
Magolo, however, suggested that the court if possible, should convert the hearing into a virtual appearance, since the health condition of Aisha does not allow her to physically attend the meeting.
According to the media, the outgoing member of parliament has been undergoing treatment at a certain hospital in Nairobi. She was admitted after her condition apparently got worse.
They lawyer who was representing her case plead with the court to suspend his warrant of arrest and should be considerate of her condition.
The lawyer stated,”We pray for the suspension of the warrant of arrest until August 23 when the case will be coming up for mention.”
The prosecution confirmed receiving a letter dated August 17 from Magolo , the lawyer, regarding the suspension of the arrest warrant.
The prosecution agreed to the request by Aisha Jumwa’s lawyer, Jared Mogolo , however, they decided the appearance to be held on a virtual meeting come the mentioning date.
In the ruling that was given by Chief Magistrate Mutuku , he declared that the case will be heard virtually on the 23rd August at 0900 hours. The Magistrate further stated that the prosecution and defendant should both be present.
Chief Magistrate Mutuku went ahead to suspended the warrant of arrest against the outgoing Malindi Member of parliament until the mentioning of the case because of Jumwa’s condition.
