Even after their suspension, The Cherera 4 ( Irene Masit, Justus Nyang’aya, Francis Wanderi and Juliane Cherera) are expecting a bountiful in their bank accounts.
If the president ascertains that the four really committed a gross misconduct and approves their dismissal, they will still get their pension.
According to the constitution,”To deny dismissed employees their benefits contravenes Articles 41(1) and (2)(b) on fair labor practices and working conditions.”
“Entitlement to pension, gratuity or any social benefit is a right to property within the meaning of Article 40 of the Constitution,” the rule of law adds.
IEBC commissioners earn an yearly salary of 9.2M. According to SRC,”State officer, serving or appointed for a fixed term of office, shall be paid a service gratuity at the rate of 31 per cent of the annual pensionable emoluments for the term served.”
Currently, the commissioners are earning half of their salaries and allowances until their case is determined.
