Court nullifies governor Kihika’s directive of matatus going back to the central business district ( CBD).
According to justice Hillary, the matatus will not go back to the CBD until the issue is heard and determined.
He stated,”Until the matter is heard and determined, an interim order be and is hereby issued suspending a declaration made by the governor on Tuesday, December 6, notifying the matatus back to the CBD.”
This comes after a section of traders, moved to court and petitioned against the governor’s order.
They stated that the central business district is better off without the matatus accessing it.
One petition stated,”Kihika’s decision is illegal, irresponsible, and abuse of principles of law and power, therefore there is an urgent need to restrain her and restore sanity.”
“The rights of the petitioners as business owners shall be greatly affected. The move will in turn bring shortcomings such as traffic jams, confusion, and total disarray in the CBD,” the petition added.
Their lawyers further stated that issuing a public order without public participation, is against the constitution.
They stated,”The impugned decision of making roadside declarations without public participation is unconstitutional and in contravention of the rights of the petitioners.”
