The office of the director of public prosecutions, ODPP details how a driver stole sh. 5. 7M worth of petrol and set tanker on fire.
In the statement, The Director of Public Prosecutions (ODPP) stated that the driver made away with 44,000 litres of petrol that were destined for Uganda.
The man, Mustafa, set the tanker on fire at the Malaba border in an attempt to conceal evidence and escape the law.
Prosecution stated,”Kiambu court has sentenced a Sibed Transporters Company Ltd driver to 10 years imprisonment for stealing 44,000 litres of petroleum worth Ksh. 5.7M, property of Vivo Energy Uganda,”
“Hon. Wilson Rading (PM) convicted Kamugisha Mustafa Ismail alias Mugisha Mustafa, after Prosecutor, Lindsey Mugambi, proved that he stole the petroleum in Eldoret, which was destined for Uganda. He set the tanker on fire at Malaba Border to conceal evidence,” read part of the statement.
In his defense, the man claimed that he opened the tank seals in an attempt to prevent an explosion.
The statement read,”Prosecution availed a similar 24 wheeler tanker to demonstrate that it takes a longer period to open a tank seal, to rebut the defense allegation that it took the accused only 5 minutes to open all 7 tank seals aimed at preventing explosion.”
“Prosecution also called fire experts to demonstrate how different products burn considering the trailer slowly burnt out and didn’t explode. Prosecution proved that the tanker didn’t explode because it didn’t have fuel,” the statement added.
