New petition in an attempt to block Cherera from Ouster hearing.
Advocate Otieno Diang’ a, has presented a new peitition in an attempt to block IEBC deputy, Juliane Cherera from attending hearings.
Otieno argued that his petition was ignored by the national assembly’s justice and legal affairs committee.
Otieno stated,”That on October 25, 2022, I forwarded three petitions to parliament for the removal of Wafula Chebukati, Boya Molu and Abdi Yakub Guliye as Commissioners of the IEBC. Attached are copies of the petitions.”
“That the said petitions were received by the National Assembly Main Records Unit where stamps were duly affixed on my copies,” he added.
The advocate further stated that on november 15, the national assembly speaker, Moses Wetangula presented 4 petitions, thereby leaving his petition out.
He stated,” I am aware that on November 16, 2022, the Clerk of the National Assembly sent four commissioners dated the same day conveying four petitions for the removal of four as commissioners of IEBC to the Departmental Committee on Justice and Legal Affairs (JLAC).
“That the hearings of the petitions before the JLAC commenced on November 24, 2022, without my petitions. That the National Assembly is discriminating me by not including my petitions that were filed prior to the ones under consideration,” he added.
He added that the act done by the legislators, broke the rule of law.
He stated,”Article 10 of the Constitution establishes rule of law, good governance, equality, human dignity and non-discrimination as some of the principles of governance. I stand to be prejudiced if the removal proceedings are conducted without considering my petitions.”
“ A declaration be and is hereby issued that failure by the First Respondent to forward the three petitions for the removal of Chebukati, Molu and Guliye as IEBC commissioners to the JLAC is discriminatory and unconstitutional.”
This comes after Raila Odinga also urged the IEBC four, to boycott the hearings because they are politically motivated.
