That is an abuse of the criminal justice system- Orengo on Gachagua’s case being withdrawn
Siaya county governor, James Orengo has called on the office of the director of public prosecutions, for dropping the DP’s 7.4B graft case.
Speaking on saturday, Orengo stated that the case was withdrawn because Rigathi Gachagua is the deputy president of the republic of Kenya.
Siaya county, first in command added that the case being withdrawn, portrays abuse of the criminal justice system.
Orengo said,” I can tell this without fear of contradiction, that if Gachagua was not the Deputy President of the Republic of Kenya, his case would not have been withdrawn.“
“ It is being withdrawn because he is the deputy president of the Republic of Kenya. That is an abuse of the criminal justice system,” he added.
Orengo further implicated Noordin Haji, saying there are many Kenyans who are innocent, but their cases can not be dropped because they have no status.
Deputy president Gachagua’s case was withdrawn on Thursday under Section 87 on the basis of lack of evidence.
Justice Wakhumile said, evidence against a case should be proven beyond reasonable doubt.
The judge further questioned the prosecution on why they would present a case with anticipated evidence.
Justice Wakhumile said,”The decision to charge must be exercised partially and independently. Never should a judicial system be used as a doormat. There is a need to respect institutions.”
The court also directed that the 12M imposed on DP Gachagua as bail, should be returned to him.
