Director of public prosecution. DPP Haji urges court to reject Waluke’s appeal, this comes after Azimio la Umoja leader, Raila Odinga drummed up for the release of Waluke.
Raila stated that it was unfair to sentence a 55 year old, to 67 years in prison.
Odinga questioned on why other graft charges were dropped but Waluke was given 67 year in jail or 1 billion bail.
Raila stated,”Now, another issue. People who are charged with murder are forgiven and approved to be cabinet secretaries. Others with multi-billion corruption cases are being left to go free. On the other hand, our people are being persecuted. Sirisia MP Waluke’s case is a civil matter.”
The DPP has maintained that the court made a constitutional decision.
DPP Haji stated,”Applicant was properly convicted and sentenced and is, therefore, until the impugned decision is overturned, serving a lawful sentence emanating from a concurrent finding of the subordinate court and the superior court.”
“This Court has held that an order for stay of proceedings, particularly stay of criminal proceedings, is made sparingly and only in exceptional circumstances,” Noordin haji added.
It is a tough time for Waluke because he may lose his parliamentary seat , if he fails to attend eight sittings of the National Assembly in a session, according to Article 103 of the Constitution.
